How: Use the IP India online portal:
https://ipindia.gov.in → Trade Marks → Public Search.
Search by: Wordmark, Vienna Code (for logos), Class (out of 45 classes).
India follows the Nice Classification System (45 classes):
Classes 1-34: Goods
Classes 35-45: Services
Use the classification tool on the IP India website to find the right class(es) for your goods/services.
Mode: Online via IP India portal or physically at a TM Registry Office.
Documents Required:
Applicant details (individual, company, etc.)
Logo or trademark (if any)
Details of goods/services
Power of attorney (if filing via agent)
Priority date claim (if applicable)
Fee (as of 2024):
₹4,500 (individual/startup/small enterprise) – online
₹9,000 (others) – online
The registry examines:
Uniqueness/conflict with existing marks
Descriptiveness or generality
Outcome:
Accepted: Moves to publication
Objected: Examination report is issued. You must respond within 1 month.
If accepted, your TM is published for 4 months for public opposition.
If opposed, you must respond and attend hearings.
If no opposition, or if you win opposition, the process continues.
Trademark is registered after successful journal publication.
You receive a Registration Certificate, valid for 10 years.
Trademark must be renewed every 10 years using Form TM-R.
Can be renewed 1 year before expiry.
